Events Terms and Conditions

1. BOOKING CONFIRMATION

Vita First Aid Pty Ltd require notification of your event 14 days prior to the event commencement date to ensure we can provide all of the services detailed in this document.

2. EVENT BOOKINGS

2.1 Event bookings will only be accepted on Vita First Aid Pty Ltd booking forms, which can be submitted via the link in the quote email..

2.2 Confirmation of all bookings will be sent via return email to the party making the booking.

2.3 Once the booking has been confirmed and the quoted price accepted then both parties will be bound under common law to a contract of acceptance with the following conditions.

3. CONFIRMATION & PAYMENT

100% payment is required upon confirming a booking.

Please Note: This quotation does not include specialist consumables such as defibrillation pads, air splints, cervical collars, ALS (Advanced Life Support) equipment, etc. These items are rarely used but if used will be itemised and charged as additional items within the final invoice.

A late payment charge of 15% will be applied after the invoice due date, and every 30 days the invoice remains unpaid.

4. PRICING

All prices exclude GST. All GST components are as stated on the quote.

All prices are valid for 30 days from the date of the quotation.

5. EVENT CANCELLATION by Client

In the event that the booking is cancelled by the client, the following fees shall apply.

5.1 Where a booking is cancelled by the client within 14 business days a fee of 50% will be applied.

5.2 Where a booking is cancelled by the client within 7 business days a fee of 75% will be applied.

5.3 Where a booking is cancelled by the client within the 24hrs of the event then 100% of the fee will apply.

6. CHANGE OF BOOKING DATE by Client

In the event that the date of the booking needs to be changed the following fees shall apply.

6.1 Where a booking is changed by the client within 30 business days a fee of 5% will be applied.

6.2 Where a booking is changed by the client within 7 business days a fee of 10% will be applied.

6.3 Where a booking is changed by the client within 3 business days a fee of 15% will be applied.

6.4 Where a booking is changed by the client within 24 hours a fee of 30% will be applied.

7. LATE FEE

Events bookings received within 48hrs of the event commencement will incur a 25% late fee. This fee will be stated on the quote provided.

8. FALSE INFORMATION PROVIDED ON BOOKING FORM

In the event that false information has been provided on the booking form, Vita First Aid reserves the right to perform the following actions.

8.1 Cancel Vita First Aid’s services immediately with no refund of fees.

8.2 Modify Vita First Aid’s services. All additional costs will be charged to the client.

8.3 Penalty fee of 20% of the total booking fee will be applied to the invoice.

All actions under this clause will be at the discretion of the Vita First Aid Duty Manager.

9. FORCE MAJEURE

Vita First Aid Pty Ltd is not liable for failure to perform the party's obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

If a party asserts Force Majeure as an excuse for failure to perform the party's obligation, then the nonperforming party must prove that the party took reasonable steps to minimise delay or damages caused by foreseeable events, that the party substantially fulfilled all non-excused obligations, and that the other party was timely notified of the likelihood or actual occurrence of an event described in this clause.

10. INSURANCES

Vita First Aid Pty Ltd are comprehensively insured for $20 million in both public liability and professional indemnity.

A higher level of insurance can be provided at the client’s request.
